Terms & Conditions

These Terms & Conditions (“Terms”) form a binding agreement between you (“you” or “User”) and The SaaSMeister LLC, a Delaware limited liability company doing business as MyPropFile (“MyPropFile,” “we,” “us,” or “our”). They govern your access to and use of mypropfile.com, the Home Truth Report, and any related features, content, and services we provide (collectively, the “Services”).

By accessing or using the Services, by submitting a property address, or by clicking a button indicating acceptance, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and Account

You must be at least 18 years old and capable of forming a binding contract under U.S. law to use the Services. You represent that any property address you submit is either your own residence, a property you are evaluating for purchase, or a property where you have a legitimate reason to obtain publicly available data, and that you are not violating any other person's privacy or contractual rights by submitting it.

The Services do not currently require a registered account. If we introduce accounts in the future, you will be responsible for keeping your credentials confidential and for all activity that occurs under your account.

2. Description of the Services

MyPropFile is a property intelligence platform. When you submit a U.S. residential address, we generate a Home Truth Report combining publicly available records, licensed third-party data, and AI-generated narrative to provide insights about:

  • Estimated current home value and equity potential;
  • Roof condition signals and permit history;
  • Pool eligibility based on lot characteristics;
  • Solar potential and projected savings;
  • Flood zone designation and related risk indicators.

We currently focus on South Florida (Miami-Dade and Broward counties). Address availability, data coverage, and specific report sections may vary by location and may change over time without notice.

3. Free Service and Contractor Referrals

The Home Truth Report is provided free of charge to homeowners and other Users. We monetize the Services primarily by referring qualified leads to vetted local contractors when a User affirmatively requests a quote, inspection, or proposal through the Services.

If you click a contractor call-to-action and confirm the connection, you authorize us to share the information described in our Privacy Policy with one or more vetted contractors operating in your service area. The contractor (not MyPropFile) is solely responsible for any quote, contract, work, materials, warranty, scheduling, payment terms, dispute resolution, or post-job service. We may receive a referral fee from the contractor for the lead.

5% Discount Codes. When you confirm a contractor connection, we generate a unique discount code and deliver it to you and the contractor. The discount is funded and honored entirely by the contractor, subject to the contractor's terms (typically applied to the total quoted job value before materials markup, on the first job quoted through the referral). MyPropFile does not subsidize, guarantee, or refund any portion of the discount.

4. SMS Messaging Consent

By submitting your phone number at the unlock gate, you expressly consent under the Telephone Consumer Protection Act (TCPA) and applicable state law to receive SMS messages from MyPropFile, including:

  • A one-time confirmation SMS containing your report link;
  • Subsequent transactional SMS messages relating to contractor connections you request, discount codes, and customer support.

Frequency: Message frequency varies. Message and data rates may apply. Consent is not a condition of any purchase.

Opt-Out: Reply STOP to any message to unsubscribe; reply HELP for assistance, or contact us at support@mypropfile.com.

Accuracy of Number: You represent that the phone number you submit is yours or that you are authorized to provide it for the purposes described in these Terms.

5. Data Sources, Estimates, and Accuracy

Our reports rely on data from public records (such as county property and permit databases and FEMA flood maps), licensed third-party providers, satellite imagery, automated valuation models, and AI-generated narrative summaries. The data is provided to us “as is” by these sources and we do not independently verify it.

  • Estimated home values, equity uplift figures, ARV ranges, and similar numbers are statistical estimates, not appraisals. They are not a substitute for a licensed appraiser, home inspector, real estate professional, attorney, accountant, or financial advisor.
  • Roof age and condition signals are derived from permit records and other indirect sources. They are not a substitute for a physical roof inspection.
  • Solar savings figures are projections that depend on weather, utility rates, system design, financing terms, and federal and state incentives that change over time.
  • Pool eligibility estimates are based on inferred lot dimensions and do not reflect HOA rules, easements, setbacks, zoning code, or site-specific conditions.
  • Flood zone designations are sourced from FEMA and may not reflect the most current revisions or local conditions.
  • AI-generated narrative summaries may contain errors or omissions and should be treated as informational only.

6. Acceptable Use

You agree not to:

  • Submit false, misleading, or unauthorized information, including phone numbers you do not own or are not authorized to provide;
  • Use the Services to harass, stalk, profile, or invade the privacy of any individual, including by submitting addresses or phone numbers belonging to other people without their consent;
  • Scrape, crawl, harvest, copy, resell, or otherwise extract data from the Services in bulk or by automated means;
  • Reverse engineer, decompile, or attempt to derive the source code of the Services or our underlying models;
  • Use the Services to compete with us, train a competing product, or build a derivative property data product;
  • Interfere with, disable, or compromise the security or integrity of the Services, including by introducing malware, attempting unauthorized access, or circumventing rate limits;
  • Use the Services in violation of any applicable law, including the TCPA, the Fair Housing Act, the Fair Credit Reporting Act, or state telemarketing and consumer protection laws;
  • Misrepresent your affiliation with MyPropFile or use our name, logo, or brand without our prior written consent.

We reserve the right to suspend, throttle, or terminate access for any User who we reasonably believe is violating these Terms.

7. Intellectual Property

The Services, including all software, design, text, graphics, logos, layouts, report templates, and AI-generated narratives, are owned by or licensed to MyPropFile and are protected by U.S. and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services and to download, print, and share your own report (including the PDF version) for personal, non-commercial use.

You may not copy, modify, distribute, sell, lease, or create derivative works from any portion of the Services or another User's report. “MyPropFile,” “Home Truth Report,” and our logos are trademarks of The SaaSMeister LLC. All rights not expressly granted to you are reserved.

8. User-Submitted Information

When you submit information to the Services (such as your address, name, phone number, optional FPL bill amount, or your relationship to the property), you grant MyPropFile a worldwide, royalty-free, non-exclusive license to use, store, process, transmit, and create derivative works from that information for the purposes described in these Terms and our Privacy Policy, including generating your report, providing customer support, sharing with contractors as authorized, and creating aggregated or de-identified analytics.

You represent and warrant that you have the right to submit any information you provide and that submission does not violate any third party's rights.

9. Third-Party Services and Contractors

The Services rely on third-party providers (including the providers identified in our Privacy Policy) and may link to or integrate with third-party websites, services, and contractors. We do not control these third parties and are not responsible for their content, products, services, availability, accuracy, or privacy practices. Your interactions with any third-party contractor are solely between you and the contractor.

MyPropFile screens contractors against basic vetting criteria but does not guarantee the quality, licensure status at the time of service, insurance coverage, workmanship, pricing, ethics, or reliability of any contractor. Before hiring any contractor, we strongly encourage you to verify their license, insurance, references, and reputation independently (for example, through the Florida Department of Business and Professional Regulation).

10. Disclaimers

THE SERVICES, INCLUDING ALL REPORTS, DATA, ESTIMATES, NARRATIVES, AND CONTRACTOR REFERRALS, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYPROPFILE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

Without limiting the foregoing, MyPropFile does not warrant that the Services will be uninterrupted, secure, or error-free; that the data, estimates, scores, or AI-generated narrative will be accurate, complete, current, or reliable; that any contractor referred through the Services will provide acceptable service; or that any projected savings, valuations, equity uplift, or insurance outcomes will be achieved.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the exclusions above apply to the maximum extent permitted by law.

11. Limitation of Liability

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID TO MYPROPFILE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow the limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless MyPropFile, its affiliates, and their respective officers, directors, members, employees, agents, and licensors from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use or misuse of the Services; (b) your breach of these Terms; (c) any information you submit, including addresses or phone numbers you were not authorized to provide; (d) your interactions with any contractor referred through the Services; or (e) your violation of any applicable law or any third party's rights.

13. Termination and Suspension

We may suspend or terminate your access to the Services at any time, for any reason or no reason, with or without notice, including if we suspect fraud, abuse, security risk, or violation of these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination (including Sections 5–12, 14–20) will survive.

14. Copyright and DMCA Notices

If you believe that content available on the Services infringes your copyright, please send a notice that complies with the U.S. Digital Millennium Copyright Act (DMCA) to support@mypropfile.com with the subject line “DMCA Notice.” Your notice must include: (1) a physical or electronic signature of the copyright owner or authorized agent; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material claimed to be infringing and its location on the Services; (4) your contact information; (5) a statement that you have a good-faith belief that the use is not authorized; and (6) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

15. Modifications to the Services and Terms

We may modify, suspend, or discontinue the Services (or any part of them) at any time, with or without notice. We may also update these Terms from time to time. If we make material changes, we will post the updated Terms at mypropfile.com/terms and update the “Last Updated” date above. Where required by law, we will provide additional notice. Your continued use of the Services after the effective date of the updated Terms constitutes acceptance.

16. Governing Law

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

17. Notices

We may give you notice by email, by SMS, by posting on the Services, or by any other reasonable means. You may give us notice by emailing support@mypropfile.com with the subject line “Legal Notice.” Notices are effective when sent (for electronic notices) or three business days after mailing (for mailed notices).

18. Binding Arbitration and Class-Action Waiver

Please read this section carefully — it affects your legal rights. By agreeing to these Terms, you and MyPropFile each agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except as set forth below.

18.1 Informal Resolution

Before initiating arbitration, you agree to first contact us at support@mypropfile.com with a brief written description of your dispute and your contact information. The parties will attempt in good faith to resolve the dispute informally for at least 30 days before pursuing arbitration.

18.2 Arbitration Procedures

Arbitration will be conducted by a single neutral arbitrator. The seat of arbitration will be Wilmington, Delaware, but the arbitrator may permit appearance by phone or video. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. Either party may seek interim or injunctive relief in court to protect intellectual property rights.

18.3 Class-Action Waiver

18.4 Opt-Out

You may opt out of this arbitration agreement by sending a written notice to support@mypropfile.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these Terms. The notice must include your name, the phone number or email associated with your use of the Services, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

18.5 Exceptions

Either party may bring an individual action in small-claims court for disputes within that court's jurisdiction. Claims relating to the validity or enforceability of intellectual property rights may also be brought in court.

18.6 Court Jurisdiction (If Arbitration Does Not Apply)

If a court of competent jurisdiction determines that the arbitration agreement does not apply to a dispute, you and MyPropFile agree that the state and federal courts located in New Castle County, Delaware will have exclusive jurisdiction and venue, and each party consents to personal jurisdiction in those courts.

19. Miscellaneous

  • Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and MyPropFile regarding the Services and supersede any prior agreements.
  • Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
  • Force Majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control.
  • Headings. Section headings are for convenience only and have no legal effect.
  • Relationship. Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and MyPropFile.
